These Terms and Conditions (“Terms”) govern your use of the website lmproremodelinggroup.com (the “Site”) operated by LM Pro Remodeling Group, an assumed name of LM Tile & Marble LLC (“we,” “us,” or “our”). By using the Site or submitting an inquiry, you agree to these Terms.

These Terms govern Site use and inquiries only. Any project work is governed by a separate written and signed contract between you and LM Tile & Marble LLC. Where these Terms and a signed project contract conflict, the signed contract controls.

Use of the website

You may use the Site for personal, non-commercial purposes — to learn about our services, view our portfolio, and submit a consultation inquiry. You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site, server, or related systems
  • Interfere with or disrupt the Site’s operation
  • Copy, reproduce, or distribute Site content (text, photos, designs) for commercial use without our written permission
  • Submit false, misleading, or fraudulent information through the contact form

We reserve the right to deny service or restrict access to anyone violating these Terms.

Intellectual property

All Site content — text, photos, project images, designs, logos, and graphics — is owned by LM Tile & Marble LLC or licensed to us, and protected by copyright and trademark law. You may not reproduce, republish, or use this content for commercial purposes without our prior written consent.

You may share links to the Site freely. You may also share individual portfolio images on personal social media accounts with attribution to LM Pro Remodeling Group.

Inquiries and consultation

Submitting an inquiry through the Site, by phone, or by email does not create a contract for services. A consultation is a free, no-obligation conversation about your project. Any project work begins only after both parties have signed a written project contract that defines scope, pricing, schedule, and other terms.

We may decline to provide a consultation or proposal at our discretion. Reasons we might decline include but are not limited to: project scope outside our service capabilities, location outside our active service area, scheduling capacity, or any other business reason.

Pricing and estimates

Any pricing discussed before a signed contract is a preliminary estimate based on the information available at the time. Final pricing is established only in a signed contract following on-site assessment, design development, and material selection. Preliminary estimates are not binding offers.

Project contract

If we agree to undertake a project, we will provide a written project contract for your review and signature. The project contract will include:

  • Scope of work
  • Materials and finish specifications
  • Pricing and payment schedule
  • Estimated start and completion dates
  • Permit and inspection responsibilities
  • Change order procedures
  • Warranty terms (see below)
  • Dispute resolution procedures

The project contract — not these Terms or any preliminary communication — governs the terms of any project work.

Warranty

We provide a 2-year workmanship warranty on all installation work performed under a signed project contract, beginning on the date of substantial completion. The workmanship warranty covers defects in our installation labor — for example, tile that loosens due to faulty setting technique, or framing that fails due to inadequate fastening.

The workmanship warranty does not cover:

  • Manufacturer defects in materials, fixtures, appliances, or finishes (these are covered, where applicable, by the manufacturer’s own warranty, which we will register on your behalf)
  • Damage caused by misuse, neglect, accident, or normal wear and tear
  • Damage caused by water intrusion from sources outside our scope of work (e.g., a roof leak above a bathroom we renovated)
  • Settlement, movement, or condition changes in the existing structure that affect our installed work
  • Cosmetic variations natural to materials (e.g., grain variation in wood, veining variation in stone)
  • Work modified, repaired, or altered by someone other than us after substantial completion

Warranty claims must be reported in writing to info@lmproremodelinggroup.com within the warranty period. We will assess the claim and, if covered, repair or replace the affected work at no charge to you.

The workmanship warranty is non-transferable. It applies only to the original homeowner who signed the project contract and only at the project address.

Licensing, insurance, and bonding

LM Tile & Marble LLC operates as LM Pro Remodeling Group. We hold:

  • New Jersey Home Improvement Contractor (HIC) license [License #]
  • New York City Home Improvement Contractor (HIC) license, where applicable to NYC project work
  • General liability insurance
  • Workers’ compensation insurance on all employees
  • New Jersey HIC Compliance Bond #M8S0060320, issued by RLI Insurance Company, in the amount of $25,000, valid through January 7, 2027 (required for residential remodeling work in NJ)

Specific license, insurance, and bond documentation is provided to clients before project start. Filings with NYC and individual NJ municipal authorities are pulled by us under our license for each project.

Limitation of liability

To the maximum extent permitted by law, our liability arising from or related to your use of the Site is limited to the amount you paid us, if any, in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages arising from Site use.

For project work, liability is governed by the signed project contract — not by these Site Terms.

Indemnification

You agree to indemnify and hold harmless LM Tile & Marble LLC, its officers, employees, and agents from any claim, demand, or damage arising from your violation of these Terms or your unlawful use of the Site.

The Site may include links to third-party websites or resources. We do not control these third parties and are not responsible for their content, accuracy, or practices. Visiting a linked site is at your own risk and subject to that site’s own terms and privacy policy.

Modifications

We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the most recent version. Continued use of the Site after a change to the Terms constitutes acceptance of the revised Terms. Material changes will be reflected in a revised version posted on this page.

We may also modify or discontinue any part of the Site at any time without notice.

Governing law and dispute resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any dispute arising from your use of the Site that cannot be resolved informally will be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the personal jurisdiction of those courts.

For project disputes, the dispute resolution procedure is governed by the signed project contract — typically including a good-faith negotiation step, followed by mediation or arbitration as specified in the contract.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire agreement

These Terms, together with our Privacy Policy and (where applicable) the signed project contract, constitute the entire agreement between you and LM Tile & Marble LLC regarding the Site and any inquiry you submit.
